Long awaited Fair Work Act Review released

The Hon Bill Shorten MP released the much anticipated review into the Fair Work Act 2009.  The Minister has indicated that the government's response will be provided 'in due course' following consultation with State and Territory counterparts and other stakeholders.  It is possible that amending legislation will be introduced in the Spring sittings.

The Review traverses significant areas of the Fair Work Act including recommendations in relation to:

  • procedures for unfair dismissal and adverse action claims, including the imposition of costs orders
  • general protections applications.
  • good faith bargaining
  • availability of protected industrial action
  • the structure and operations of Fair Work Australia and the Fair Work Ombudsman

Despite making 53 recommendations in total, the Review was positive about the operation of the legisation.
